Quick guide on the new UK eVisa Rules

This guide covers the essential information on the UK's new eVisa system for those holding physical immigration documents like BRPs, BRCs, vignette stickers, or wet ink stamps in passports.

Transition to eVisas

The UK government is digitizing immigration status proof, moving from physical documents to an online record known as an eVisa. This change, which has been in effect for the EU Settlement Scheme, is now expanding to a broader range of individuals. As of 21 March 2024, the government has updated their guidance on eVisas.

Documents Replaced by eVisas

The following physical documents will be replaced by an eVisa:

  • Biometric Residence Permits (BRP)
  • Biometric Residence Cards (BRC)
  • Passport endorsements (indefinite leave to enter wet ink stamps)
  • Vignette stickers in passports (entry clearance or visa vignettes)
  • Vignette stickers in immigration status documents

If you possess any of these documents, it is crucial to stay informed through Home Office guidance and correspondence. Transitioning to an eVisa does not alter your immigration status or the conditions of your stay in the UK.

How to Obtain an eVisa

To access your eVisa, you need to create a UKVI account, which is free. A tutorial video released by UKVI on 15 May 2024 explains the process. Additionally, an eVisa Webchat function is available to assist with account setup or access issues.

Note: You must create your own account. It should be linked to your personal details to keep it updated accurately.

Updates as of 20 May 2024

The Home Office has started issuing instructions for creating UKVI accounts post-grant of leave. During this transitional period, BRPs will still be issued for those granted leave before December 2024, but you can create your account before receiving the BRP. A generic account creation link will be accessible from June 2024 for all BRP holders.

If You Have a BRP

Those granted leave from 1 January 2020 received BRPs expiring on 31 December 2024, regardless of the actual leave expiry. UKVI will contact you to create an account, but you can also sign up for updates on when an eVisa account will be available.

If You Have a Passport Endorsement or Vignette Sticker

For passport endorsements or vignette stickers indicating indefinite leave to enter or remain, you must apply for a ‘no time limit’ (NTL) application. Upon successful application, you will receive a BRP and later create an eVisa account. Continue using your current documents until then.

If You Have a BRC

BRCs issued under the EU Settlement Scheme (EUSS) remain valid. However, BRCs with non-EUSS leave are no longer valid post-Brexit. Late EUSS applications are possible with a valid reason. If you are unsure about your eVisa status, contact the Home Office.

For Student Visa Holders

Since 3 April 2024, student visa holders are being invited to create eVisa accounts. Invitations are sent by email, with a phased approach to transition.

Benefits of eVisas

An eVisa account provides comprehensive details of your immigration status, including permission type, expiration, and rights (e.g., to work, rent, access public funds). You can share this information via a share code with relevant parties. The eVisa eliminates the need for physical documents, linking your status directly to your passport.

Potential Issues with eVisas

While eVisas are convenient, they require some technological proficiency. The Home Office is not liable for any loss or damage arising from the use of the UKVI account. Account security breaches can result in suspended access, impacting your ability to prove legal presence in the UK.
